Emerald Moments Travel, LLC (“Emerald Moments Travel,” “EMT,” “we,” “us,” or “our”) provides professional travel-advisory and travel-planning services specializing in river cruises, small-ship ocean cruises, curated land journeys, and hosted travel experiences.
These Terms and Conditions (“Terms”) govern travel-planning services and travel arrangements made through Emerald Moments Travel. Please read them carefully before asking us to make or confirm travel arrangements.
1. CONTRACT, ACCEPTANCE, AND CHANGES TO THESE TERMS
These Terms, together with applicable proposals, invoices, confirmations, written agreements, and the terms and conditions of the independent travel Suppliers involved in your arrangements, form the agreement between Emerald Moments Travel and the traveler (“Traveler,” “you,” or “your”).
A Traveler accepts these Terms by electronically agreeing to them, authorizing EMT to make a reservation or payment, paying a professional fee or travel deposit, or otherwise instructing EMT to confirm travel arrangements on the Traveler’s behalf.
If you request or manage travel for another person, you represent that you are authorized to provide the information necessary to arrange that person’s travel and to act on that person’s behalf where appropriate. You are responsible for ensuring that all Travelers included in the arrangements receive applicable travel documents, Supplier terms, and important information provided by EMT.
The Terms accepted in connection with a booking govern that booking. EMT may revise these Terms from time to time for future services and bookings. A later revision will not automatically modify the Terms governing an existing confirmed booking unless the parties expressly agree otherwise or a change is required by applicable law.
2. TRAVELER RESPONSIBILITIES, CONDUCT, AND MATERIAL BREACH
Travelers are responsible for providing accurate and timely information, reviewing documents provided by EMT or a Supplier, making required payments by the applicable deadlines, and complying with Supplier policies and applicable laws and regulations.
EMT may decline, suspend, or discontinue services, or may request cancellation of arrangements where permitted by the applicable Supplier, if a Traveler:
materially breaches these Terms or another agreement with EMT;
fails to make a required payment when due;
provides materially false or fraudulent information;
engages in unlawful activity relating to the booking or travel arrangements;
engages in threatening, abusive, harassing, or seriously disruptive conduct toward EMT, a Supplier, another traveler, or other person involved with the trip; or
otherwise engages in conduct that makes EMT’s continued provision of services unreasonable or unlawful.
Any cancellation, forfeiture, refund, or credit resulting from such circumstances remains subject to applicable Supplier terms and applicable law. EMT will not impose a forfeiture of Supplier-held funds beyond what the applicable Supplier terms or law permit.
3. EMT'S ROLE, INDEPENDENT SUPPLIERS, AND TRAVELER-BOOKED ARRANGEMENTS
EMT provides travel-advisory, planning, coordination, and reservation services. Many components of your trip are provided by independent third-party travel suppliers (“Suppliers”).
Suppliers may include, among others:
airlines;
cruise lines;
tour operators;
hotels and resorts;
rail companies;
transfer and transportation providers;
rental-car companies;
destination-management companies;
excursion providers;
guides;
travel-protection providers; and
other companies or individuals providing travel-related products or services.
EMT does not own, operate, manage, supervise, or control these independent Suppliers or their employees, equipment, vehicles, ships, aircraft, accommodations, facilities, or operations.
Each Supplier is responsible for the travel product or service it provides. Supplier terms, conditions, tariffs, cancellation policies, privacy practices, passenger contracts, and other requirements may apply to your arrangements.
EMT may assist in communicating with a Supplier and advocating for a Traveler when a problem arises, but EMT does not control a Supplier’s operations, decisions, performance, refund processing, staffing, schedule, equipment, or policies.
To the fullest extent permitted by applicable law, EMT is not responsible for the acts, omissions, errors, delays, defaults, or failures of independent Suppliers or for events outside EMT’s reasonable control.
Arrangements Made Outside EMT
EMT is not responsible for travel arrangements that you book directly or through another travel agency, website, advisor, Supplier, credit-card portal, loyalty program, or other provider unless EMT expressly agrees in writing to manage that arrangement.
If you change, cancel, rebook, upgrade, or otherwise modify an arrangement directly with a Supplier without informing EMT, you are responsible for the consequences of that change, including any fees, schedule conflicts, lost benefits, missed connections, or other effects on the remainder of your itinerary.
When possible, please communicate requested changes through EMT so we can understand how they may affect the complete journey.
4. PROFESSIONAL FEES, BOOKING, AND PAYMENT
EMT may charge professional planning, consulting, air-management, change, research, Hosted Journey, or other service fees.
Any applicable EMT professional fee will be disclosed before it is incurred. Unless otherwise stated in writing or required by applicable law, EMT professional fees are non-refundable because they compensate EMT for professional services performed rather than for the underlying travel products supplied by third parties.
The amount and scope of any professional fee may be stated in a proposal, planning agreement, invoice, Tern workflow, email, or other written communication.
A professional fee may be charged separately from Supplier deposits and payments.
When you authorize a booking, you are responsible for paying the deposit or other amount required by the applicable Supplier. EMT will communicate known payment deadlines and, when appropriate, provide reminders as a convenience.
Supplier final-payment deadlines vary by Supplier, product, fare, and booking. If a booking is made after the applicable final-payment deadline, full payment may be required at the time of booking.
You remain responsible for ensuring all required payments are made in full and on time.
If a required payment is not received by the applicable deadline, a Supplier may cancel the reservation or impose penalties. Failure to make a required payment may be treated as a cancellation by the Traveler and may result in the loss of deposits or other amounts under the Supplier’s cancellation policy.
Some fares, promotional rates, deposits, and travel products are restricted or non-refundable.
After booking, EMT will provide or make available applicable confirmations, invoices, and other travel information received from Suppliers.
Please review all confirmations, invoices, names, dates, cabin or room categories, flights, itinerary details, payment deadlines, cancellation terms, and other documents promptly. Notify EMT as soon as possible if you believe something is incorrect.
5. PRICING, AVAILABILITY, AND CHANGES
Prices shown in proposals, advertisements, websites, emails, or other communications are based on information available at the time presented and are subject to availability, confirmation, Supplier terms, and correction of errors.
A quote does not guarantee that space, airfare, a cabin, room, tour, fare, promotion, amenity, or other travel product will remain available until the Supplier confirms the reservation.
Travel pricing may change before confirmation.
Prices may include or be affected by items such as:
airfare;
fuel charges;
taxes;
port charges;
government fees;
currency fluctuations;
local charges;
Supplier surcharges;
transportation costs; and
other costs associated with the travel arrangements.
Once a booking is confirmed, any subsequent price adjustment is governed by the applicable Supplier’s terms and applicable law.
EMT reserves the right to correct typographical, calculation, or pricing errors before a reservation is confirmed. If EMT discovers a material pricing error, we will notify you and provide the then-available options.
6. TRAVELER INFORMATION, IDENTIFICATION, AND TRAVEL DOCUMENTS
You are responsible for providing accurate traveler information.
Names used for reservations should be provided exactly as required by the applicable Supplier and should match the passport or other government-issued identification the Traveler will use for travel.
International travel and certain domestic travel products may require information such as:
full legal name;
date of birth;
citizenship or nationality;
passport details;
Known Traveler Number;
Redress Number; or
other information required by a Supplier or government authority.
Name corrections after tickets or reservations have been issued may result in fees, rebooking, cancellation, or the purchase of a new ticket or reservation at the then-current price.
Passports, Visas, and Entry Requirements
Each Traveler is responsible for obtaining, verifying, and carrying all documentation required for the journey, including as applicable:
passports;
visas;
electronic travel authorizations;
identification;
consent documents for minors;
vaccination or health documentation;
entry or transit documents; and
other documents required by governments or Suppliers.
Passport-validity requirements vary by destination. Some destinations require a passport to remain valid for a specified period beyond the travel dates.
U.S. citizens should review current destination and document requirements through travel.state.gov and the appropriate destination government, embassy, or consulate.
Requirements can change before departure, including requirements in countries through which you are merely connecting or transiting.
Non-U.S. citizens may be subject to different requirements and should consult the appropriate government authorities.
Domestic U.S. Air Identification
REAL ID enforcement began May 7, 2025. Travelers age 18 and older using U.S. airport security checkpoints should carry identification currently accepted by the Transportation Security Administration. Travelers who do not use a REAL ID-compliant state identification document may use another form of identification accepted by TSA, when applicable.
Travelers should review current requirements at tsa.gov before departure.
Minors
Children and infants may require passports, visas, consent letters, custody documentation, or other documents depending on the itinerary.
Adults traveling with minors are responsible for determining and carrying any documents required by governments or Suppliers.
Criminal History and Entry Eligibility
Certain destinations may restrict entry based on a traveler’s criminal history or other legal circumstances.
Travelers with a criminal history or other concern that may affect entry should independently confirm their eligibility with the appropriate destination government or seek qualified legal advice before booking.
You are not required to disclose your criminal history to EMT.
EMT cannot guarantee that any government authority will admit a Traveler.
7. AIR RESERVATIONS, FLIGHT CHANGES, BAGGAGE, AND CHECK-IN
When EMT arranges airfare, your transportation contract is with the applicable air carrier and is subject to the carrier’s terms and applicable law.
Airline schedules, flight numbers, aircraft, routings, connections, seats, gates, and operating carriers may change.
Airlines may charge fees for services such as:
checked baggage;
carry-on baggage;
advance seat assignments;
preferred seating;
changes;
cancellations; or
other optional or ancillary services.
Unless otherwise expressly agreed, EMT is not responsible for airline-imposed ancillary fees.
Refund eligibility for canceled, delayed, or significantly changed flights is governed by the carrier’s terms and applicable law, including any non-waivable passenger refund rights.
Nothing in these Terms is intended to waive any passenger right that cannot legally be waived.
Travelers should review airline communications and reconfirm their flight schedule before departure.
Travelers are responsible for completing airline check-in, arriving at the airport within the carrier’s recommended time, monitoring schedule or gate changes, and complying with baggage, identification, security, and boarding requirements.
8. CREDIT CARD AUTHORIZATION AND CHARGEBACKS
When you authorize EMT or a Supplier to charge a credit or debit card, you authorize the stated transaction and acknowledge that the transaction may be subject to these Terms and the applicable Supplier’s terms.
EMT may use payment systems operated by Suppliers, our host agency, Tern, payment processors, or other approved providers.
You agree not to initiate a chargeback that you know to be fraudulent or based solely on disagreement with a valid cancellation policy or other contractual term after properly authorizing the transaction.
If you have a concern regarding a charge, please contact EMT promptly so we can attempt to understand and resolve the issue or assist with the applicable Supplier.
EMT retains the right to respond to and dispute an improper chargeback and to provide documentation showing the authorization, reservation, Supplier policy, cancellation terms, communications, or services involved.
Nothing in this section limits any non-waivable rights available to you under applicable consumer-protection, credit-card, or billing-error laws.
A chargeback does not itself cancel a travel reservation. If a payment is reversed, the affected Supplier may cancel the reservation or impose consequences under its terms.
9. CANCELLATION BY THE TRAVELER
Requests to cancel travel should be provided to EMT in writing.
Cancellation penalties vary by Supplier and travel product. Supplier cancellation policies apply to your booking.
Professional fees paid directly to EMT are non-refundable unless otherwise stated in writing or required by applicable law.
When EMT receives a cancellation request, we will communicate the request to applicable Suppliers and assist with determining any available refund, future travel credit, or other remedy.
The effective cancellation date used by a Supplier may depend on when the Supplier receives or processes the cancellation under its own rules.
If a Supplier owes you a refund, the Supplier is generally responsible for issuing that refund. EMT is not required to advance or fund a Supplier refund before EMT receives the applicable refundable funds.
Supplier processing times may vary.
Where permitted by applicable Supplier terms and law, a Supplier may offer a future travel credit, voucher, rebooking option, or other remedy instead of or in addition to a refund.
Airline refund rights remain subject to applicable law, and nothing in these Terms eliminates a passenger refund right that cannot legally be waived.
10. SUPPLIER CHANGES, CANCELLATIONS, REFUNDS, AND UNUSED SERVICES
Suppliers may change or cancel travel arrangements for operational, safety, weather, scheduling, governmental, commercial, or other reasons.
Changes may include, among other things:
schedules;
aircraft;
ships;
ports;
hotels;
itineraries;
tours;
excursions;
transportation;
guides;
dining;
activities; or
other components of the trip.
EMT will communicate significant Supplier changes of which we are notified and, when appropriate, assist you in reviewing alternatives offered by the Supplier.
EMT does not control the Supplier’s decision or the alternatives, refunds, credits, or compensation the Supplier makes available.
Whether a change or cancellation creates a right to a refund, credit, rebooking, or other remedy is governed by the applicable Supplier’s terms and applicable law.
Once travel has begun, many Suppliers do not provide refunds for services voluntarily missed or unused by a Traveler.
Refunds or credits for unused travel arrangements are governed by the applicable Supplier’s terms and applicable law.
EMT does not independently guarantee reimbursement for voluntarily unused arrangements.
11. TRAVEL PROTECTION
Travel involves financial risk, and EMT strongly recommends that Travelers consider appropriate travel-protection coverage.
Depending on the policy purchased, coverage may include benefits relating to:
trip cancellation;
trip interruption;
emergency medical expenses;
emergency evacuation or repatriation;
baggage;
travel delay;
missed connections; or
other covered events.
Coverage varies significantly between policies.
Cancel for Any Reason (“CFAR”) coverage may be available with certain plans. CFAR is not available for every Traveler or booking and is subject to the policy’s eligibility requirements, purchase deadlines, cancellation deadlines, reimbursement limits, exclusions, and other terms.
Other insurance benefits may also be time-sensitive.
EMT is not qualified to interpret technical insurance terms, determine whether a particular event will be covered, or evaluate the adequacy of a Traveler’s existing insurance coverage.
Questions regarding policy coverage, benefits, exclusions, claims, or existing coverage should be directed to the insurer, plan administrator, licensed insurance producer, or other qualified insurance professional identified with the applicable plan.
EMT may provide general descriptive information about available travel-protection products where permitted, but the insurance policy and documentation issued by the insurer control.
Certain destinations may require proof of medical or other insurance as a condition of entry. Travelers are responsible for reviewing and satisfying such requirements.
If you decline travel protection, you accept the financial risk associated with cancellation, interruption, medical treatment, evacuation, delay, lost baggage, or other events for which insurance might otherwise provide benefits.
12. DESTINATION CONDITIONS, PUBLIC HEALTH, FORCE MAJEURE, AND INHERENT TRAVEL RISKS
Travel involves risks that cannot be completely eliminated.
These may include, depending on the itinerary:
illness or infectious disease;
accident or injury;
weather;
high or low water conditions;
natural disasters;
transportation disruption;
mechanical or infrastructure failures;
strikes or labor disputes;
political or civil unrest;
crime;
terrorism;
war;
government action;
border closures;
quarantine;
public-health restrictions;
Supplier closures;
remote locations;
limited medical facilities;
delays or cancellations;
changes in local conditions; and
other circumstances outside EMT’s reasonable control.
Government warnings, entry requirements, health requirements, and destination conditions can change before or during travel.
Travelers are responsible for reviewing current destination information and determining whether they are comfortable traveling under the known circumstances.
U.S. Travelers should review current destination information and Travel Advisories through travel.state.gov and current travel-health guidance through the Centers for Disease Control and Prevention.
The existence of a Travel Advisory does not by itself determine whether EMT or a Supplier will cancel a trip or whether a Traveler is entitled to a refund.
A Traveler who chooses to proceed with travel despite known destination risks, warnings, weather conditions, public-health concerns, or other conditions accepts the ordinary and inherent risks associated with that decision, subject to applicable law.
Force Majeure
EMT is not responsible, to the fullest extent permitted by applicable law, for delay, interruption, change, cancellation, additional expense, or inability to perform its services when caused by circumstances beyond EMT’s reasonable control.
Such circumstances may include natural disasters, severe weather, floods, high or low water levels, fire, earthquake, epidemic, pandemic, public-health emergency, war, terrorism, civil unrest, governmental action, strikes, transportation interruption, border restrictions, power or communications failures, Supplier failure, or comparable events.
Any refund, credit, rebooking right, or other remedy relating to a Supplier service affected by such an event is governed by the applicable Supplier’s terms and applicable law.
If EMT receives refundable Supplier funds that are due to you, EMT will pass those funds to you, subject to any lawful and previously disclosed fees.
13. ACCESSIBILITY, MOBILITY, DIETARY NEEDS, HEALTH, AND FITNESS TO TRAVEL
Please tell EMT about any accessibility, mobility, dietary, or other travel-related need that may affect the suitability or delivery of the travel arrangements you are considering.
You do not need to provide EMT with a complete medical history.
EMT will make reasonable efforts to communicate relevant requests to Suppliers, but EMT cannot guarantee that a Supplier, destination, ship, hotel, vehicle, attraction, or other facility will be able to provide a requested accommodation.
Accessibility standards vary significantly by Supplier and destination, particularly outside the United States.
Airlines operating flights subject to U.S. disability law may have specific obligations to passengers with disabilities. Travelers requiring airline assistance should communicate their needs to EMT and, where appropriate, directly to the carrier.
Cruise lines, tour operators, hotels, ground-transportation providers, excursions, and other Suppliers may impose legitimate mobility, health, fitness, safety, or participation requirements.
Some activities may require Travelers to walk certain distances, climb stairs, navigate uneven surfaces, enter or exit vehicles or watercraft, or meet other physical requirements.
It is the Traveler’s responsibility to consider whether an itinerary is appropriate for their individual circumstances and to consult an appropriate healthcare professional when necessary.
EMT may provide activity-level or accessibility information received from Suppliers but does not independently provide medical advice or determine a Traveler’s fitness to travel.
Pregnancy
Airlines, cruise lines, tour operators, and other Suppliers may impose pregnancy-related restrictions or documentation requirements.
Travelers who are pregnant or may be pregnant during travel are responsible for reviewing applicable Supplier policies and consulting an appropriate healthcare professional.

14. PERSONAL PROPERTY
Travelers are responsible for safeguarding passports, identification, money, medications, electronics, baggage, valuables, and other personal property.
Baggage handling and liability are generally governed by the terms of the carrier or other Supplier responsible for the baggage at the relevant time.
EMT is not responsible for lost, stolen, delayed, damaged, or misplaced personal property except to the extent otherwise required by applicable law.
Travelers should consider keeping essential medications, identification, travel documents, and other critical items in their personal possession rather than checked baggage when appropriate.
15. AIRCRAFT INSECTICIDE NOTICE
Certain countries require or permit airlines to treat aircraft cabins with insecticides in connection with international travel.
Travelers who are concerned about aircraft insecticide treatment should review current information provided by the U.S. Department of Transportation and the applicable airline before travel.
16. INDEMNIFICATION FOR TRAVELER CONDUCT
To the fullest extent permitted by applicable law, a Traveler agrees to indemnify and hold EMT harmless from third-party claims, losses, or reasonable costs arising directly from:
the Traveler’s intentional or unlawful conduct;
material damage caused by the Traveler to another person’s property or a Supplier’s property; or
the Traveler’s material breach of these Terms,
except to the extent the claim or loss was caused by EMT or is otherwise not subject to indemnification under applicable law.
Suppliers may also impose their own passenger-conduct rules and may remove a Traveler from a trip or deny services where permitted under their terms and applicable law.
Any refund following removal by a Supplier will be governed by the Supplier’s terms and applicable law.
17. GOVERNING LAW AND VENUE
These Terms and the rights of the parties arising from EMT’s professional services shall be governed by the laws of the State of Tennessee, without regard to conflict-of-law principles, except where another law must apply and cannot legally be waived.
Subject to any non-waivable rights provided by applicable law, disputes relating to EMT’s services shall be brought in a court of competent jurisdiction in Cumberland County, Tennessee.
Nothing in these Terms waives any right or remedy that cannot legally be waived.
18. ENTIRE AGREEMENT AND SEVERABILITY
These Terms, together with any applicable written planning agreement, proposal, invoice, booking confirmation, authorization, and Supplier terms provided or incorporated into the travel arrangements, constitute the agreement relating to the services addressed by those documents and supersede prior communications concerning the same subject matter.
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as appropriate, and the remaining provisions will continue in effect.
A failure by EMT to enforce a provision on one occasion does not waive the right to enforce that provision later.
